This Legal Notice and Disclaimer contains important legal information regarding the use of the website https://skykite.com.tr ("SkyKite" or "Platform"). By using the Platform, you accept the conditions specified in this text.
1. Nature of the Service and the Platform's Legal Status
SkyKite is merely an information and matching platform connecting passengers traveling from Northern Cyprus (TRNC) to Turkey (or vice versa) with users who want to have items brought accompanied by passengers. The Platform does not provide transportation services, does not assume the role of carrier, contractor, or commercial intermediary, and does not charge commissions or brokerage fees for transactions between users. The agreement, payment, delivery of the item, and all similar processes between users are subject exclusively to the relationship they establish between themselves.
Status under legislation: SkyKite acts as an intermediary service provider under Law No. 6563 on the Regulation of Electronic Commerce and its secondary legislation, and as a hosting provider under Law No. 5651. In the item-carrying relationship established between users through the Platform, SkyKite is not the seller, carrier, financial intermediary, or a party to the distance contract; agreements regarding items are concluded directly between the users under the Turkish Code of Obligations No. 6098. Sales of membership and subscription services offered by SkyKite itself, however, constitute a distance contract concluded between SkyKite and the user; in such transactions SkyKite acts as the seller/service provider, and the mandatory provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation apply.
SkyKite is a technology platform that operates in compliance with applicable legislation. SkyKite does not permit the carriage, brokerage, or sourcing of any illegal goods; activities contrary to applicable legislation are also contrary to the Platform's terms of use.
2. Fraud Warning and Safe Transaction Rules
SkyKite applies a zero-tolerance policy against fraud, forgery, and abuse. Acts such as using fake accounts or documents, deceptive listings and offers, requesting products without paying, failing to pay for an item received, identity theft, sharing phishing links or fake payment pages, and directing users outside the Platform to unrecorded and unprotected payments may constitute the crime of fraud under Turkish Criminal Code No. 5237. In acts constituting a crime, SkyKite cooperates with competent judicial and administrative authorities and makes the notifications required by legislation; in such cases, transaction records and relevant data may be shared with competent authorities.
Basic rules you must observe for your safety:
- SkyKite officials will never, under any circumstances, request your password, SMS/e-mail verification code, bank/credit card details, or remote access applications. Such requests are fraud attempts; do not trust them and report them immediately to info@skykite.com.tr.
- Be cautious of requests that direct you to external messaging apps, social media, or other websites and that suggest urgency, pressure, or secrecy. Keep communication on the Platform whenever possible.
- Make payments in a way that leaves a receipt or collection record; before payment, verify that the IBAN matches exactly the information shown on the transaction page. Do not pay unknown third-party accounts.
- If you are unsure about the authenticity of products, listings, or payment evidence, do not proceed with the transaction; report suspicious users, listings, and messages to the Platform. Reports are reviewed in accordance with privacy principles.
Since SkyKite is not a party to or guarantor of transactions between users, responsibility in all legal disputes, including fraud, belongs to the relevant users. Nevertheless, SkyKite reserves the right to review suspicious activity, suspend accounts, and notify competent authorities in order to prevent harm.
3. Customs Information Is Not Legal Advice
The customs limits, exemptions (such as the 430 Euro value limit for passenger-accompanied items), prohibited/restricted items, and similar content on the Platform are for general informational purposes only; they do not constitute legal advice, consultancy, or official declarations. Customs legislation changes frequently; no guarantee is given regarding the currency of the information. For binding information on your personal situation, please refer to the official sources of the Turkish Ministry of Trade Customs Administration, a customs broker, or other authorized bodies. All consequences of transactions made based on this information belong to the User.
4. Customs Declaration, Taxes, and Legal Responsibility Belong to the User
Submitting customs declarations, declaring the item, paying customs duties and taxes — all customs procedures and the legal responsibility arising from them belong exclusively to the User. SkyKite does not perform customs procedures, submit declarations, or pay taxes on behalf of any User. Administrative, financial, and criminal liabilities arising from false or incomplete declarations, carrying prohibited items, bringing commercial quantities, and similar violations belong personally to the User. Income tax and other financial obligations that may arise from transactions between Users also belong exclusively to the relevant User.
5. Disclaimer for Transactions Between Users
SkyKite is not a party to or guarantor of transactions established between users. The accuracy of users' identities, declarations, listings, and offers is the sole responsibility of the relevant User. SkyKite cannot be held liable in any way for transactions between users, payments, damage to, loss of, delay in, non-delivery of the item, fraud, or any other damage and disputes. Resolution of disputes is the sole responsibility of the relevant users.
6. No Guarantee of Accuracy and Currency of Information
Content on the Platform is provided "as is". SkyKite gives no express or implied warranty regarding the accuracy, completeness, currency, or fitness for a particular purpose of the site content. Service interruptions may occur due to technical failures, maintenance-related outages, unforeseeable events, and similar reasons; SkyKite is not liable for indirect damages arising from such events.
7. External Links and Third-Party Content
The Platform may contain links to third-party websites and content. These links are provided for convenience only; the content, terms of use, and privacy practices of the linked sites are the sole responsibility of the relevant site. SkyKite does not review the content of external sites and is not liable for damages arising from reliance on information or services on these sites. Additionally, content uploaded by users (listings, reviews, messages) reflects the views of the relevant User and does not bind the views of SkyKite.
8. Intellectual and Industrial Property
All content of the Platform, including its design, texts, logos, the name and trademark "SkyKite", belongs to SkyKite or its licensors and is protected under the Turkish Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769. The content of the Platform may not be copied, reproduced, distributed, or used for commercial purposes without SkyKite's written permission. Any use beyond the personal use permitted by the Platform is prohibited.
9. Transaction Records and Cooperation with Competent Authorities
All membership, listing, request, offer, messaging, payment, and delivery transactions carried out on the Platform are recorded. Transaction records and security audit records (IP, device, session, and transaction logs) are retained for the periods prescribed by Law No. 6563, Law No. 5651, and relevant legislation. Where duly requested by competent courts, prosecutors' offices, law enforcement units, customs administration, and other competent public institutions, these records may be shared with the relevant authorities for submission to legal authorities. SkyKite cooperates with competent authorities for the purposes of combating crime and protecting public order.
10. Right to Amend
SkyKite reserves the right to update this Legal Notice and Disclaimer at any time without prior notice. The current text enters into force upon publication on the Platform. Last updated: 14.09.2026.
