Terms of Service

By using our platform, you agree to the following terms. Please read carefully.

Effective Date: 03.09.2026 — Last Updated: 14.09.2026

This User Agreement ("Agreement") is concluded between the website operated at https://skykite.com.tr ("Platform" or "SkyKite") and the user who registers on and uses the Platform ("User" or "You"). By visiting, registering, or using any service of the Platform, you are deemed to have read, understood, and accepted all provisions of this Agreement. If you do not accept this Agreement, please do not use the Platform.

1. Subject and Scope

The subject of this Agreement is to determine the legal terms of the relationship between the Platform and the User regarding the matching service offered by SkyKite. The Agreement covers all pages, functions, mobile applications, and related digital channels of the Platform. By registering or using the Platform, the User also accepts the privacy policy, KVKK disclosure text, cookie policy, and all other policies published on the Platform.

The Agreement includes the regulations concerning the relationships that the User establishes on the Platform between passengers traveling from Northern Cyprus (TRNC) to Turkey ("Passenger") and users who want to have items brought ("Requester"), the Platform's position in this relationship, and the mutual rights and obligations of the parties.

2. Definitions

  • Platform / SkyKite: The matching website operating at https://skykite.com.tr and its related digital channels.
  • Passenger: A user traveling from TRNC to Turkey (or vice versa) who declares passenger-accompaniment carrying capacity.
  • Requester: A user who creates an item request on the Platform.
  • Offer: The price, date, and conditions declared by a Passenger for an item request.
  • Transaction: The matching initiated on the Platform between a Requester and a Passenger and the agreement formed between the parties as a result.
  • KVKK: The Turkish Personal Data Protection Law No. 6698.
  • Customs Legislation: All laws, decrees, regulations, communiqués, and circulars of the Republic of Turkey in force regarding the carriage of items accompanied by passengers, including Customs Law No. 4458.

3. Scope of the Service: Matching Only

SkyKite is a matching intermediary platform that facilitates the meeting of Requesters and Passengers. Users create listings, publish requests, give and accept offers, and communicate with each other on the Platform.

The User expressly and specifically accepts that SkyKite:

  • does not provide transportation, freight, logistics, or courier services and is not a party to or guarantor of such services;
  • does not act as a commercial intermediary, broker, or merchant;
  • does not assume the roles of carrier, sender, recipient, warehouse keeper, or customs broker in any way;
  • does not charge any commission, brokerage fee, or similar deduction (payments between Users are made directly between themselves);
  • is not a party to the agreement between Users and has no creditor or debtor position in its formation, performance, or termination.

The determination of the transaction price, payment, delivery of the item, and similar matters are subject exclusively to the legal relationship the Users freely establish between themselves. The nature of the legal relationship between Users (including whether it falls within the scope of the Labor Law, Code of Obligations, Commercial Code, or other legislation) is a matter for the parties alone; SkyKite is not a party to it.

Platform's status under e-commerce legislation: SkyKite acts as an intermediary service provider under Law No. 6563 on the Regulation of Electronic Commerce and its secondary legislation, and as a hosting provider under Law No. 5651. In item transactions between Users, SkyKite is not the seller, carrier, financial intermediary, or a party to the distance contract; such transactions are based on the contract concluded directly between the Users under the Turkish Code of Obligations No. 6098, and any consumer rights arising therefrom (if any) are exercised against the relevant seller/service provider.

Sales of membership, subscription, and similar digital services offered by SkyKite itself, however, constitute a distance contract concluded between SkyKite and the User. In such transactions, SkyKite acts as the seller/service provider, and the mandatory provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation apply. The User has the information and withdrawal rights arising from legislation in subscription purchases; exceptions provided by legislation (e.g., digital services performed immediately) are reserved.

SkyKite is a technology platform that operates in compliance with applicable legislation; it fulfills its tax obligations arising from its own commercial activity. Income tax, duties, and other financial obligations that may arise from transactions between Users belong exclusively to the relevant User.

4. Compliance with Customs Legislation

The User accepts and declares that the responsibility for compliance with Customs Legislation rests entirely and exclusively with the User. Information presented on the Platform regarding customs limits and exemptions (such as the 430 Euro value limit for passenger-accompanied items) is general guidance only; it is not current, case-specific, or legally binding information. Customs legislation may change; for the most accurate and up-to-date information, the official sources of the Turkish Ministry of Trade Customs Administration or a customs broker should be consulted.

The User expressly accepts that:

  • Researching in advance whether the item falls within customs exemption limits and acting accordingly is the User's own responsibility.
  • For items exceeding the exemption limits, customs duties and taxes must be declared and paid.
  • Bringing items in commercial quantities or of a commercial nature is contrary to the purpose of the passenger-accompanied items regime and may additionally constitute a violation of legislation.
  • Checking whether any item is prohibited, restricted, or subject to permission is the User's responsibility.

5. Customs Declaration, Taxes, and Legal Responsibility

Submitting customs declarations, declaring the item, paying customs duties and taxes where applicable, and all administrative, financial, and criminal liability arising from false or incomplete declarations belong entirely to the User. SkyKite does not perform any customs procedures on behalf of Users, does not submit declarations, does not pay taxes, and does not act as a representative in these matters. The User is solely responsible for violations of declaration obligations, smuggling offenses, administrative fines, and all other sanctions arising from Customs Legislation.

The Passenger is personally responsible for all consequences of carrying items for non-personal use or in commercial quantities. The Requester is responsible for the legality of the items requested to be brought. If any violation of these responsibilities by a User causes damage to SkyKite or third parties, the relevant User undertakes to compensate such damage without any defense of disclaimer.

6. Prohibited Items

The following items are strictly prohibited from being made the subject of requests, listings, offers, or messages on the Platform for the purpose of being brought:

  • Narcotics, drugs, and psychotropic substances;
  • Weapons, ammunition, explosives, and their parts; defense industry items;
  • Counterfeit (fake) branded products and all products infringing intellectual/industrial property rights;
  • Endangered species and products thereof; animal and plant species covered by the CITES convention;
  • Publications banned by law;
  • Live animals and dangerous animal species; products within the scope of animal rights violations;
  • Antique natural assets and items of cultural or natural heritage;
  • Herbal supplements, food supplements, medicines, and medical products requiring health declarations;
  • Alcohol and tobacco products, fuel, and similar specially regulated products (subject to customs quotas and restrictions);
  • Currencies, precious metals and jewelry, negotiable instruments;
  • Radioactive, corrosive, toxic, explosive, and flammable substances;
  • Biological, chemical, and nuclear hazardous substances;
  • All other items whose carriage, importation, or possession is prohibited or restricted under Turkish and TRNC legislation;
  • Content contrary to public morals, obscene content, and any content violating children's rights.

This list is exemplary and is not to be interpreted restrictively; Customs Legislation and relevant legal regulations shall prevail in all cases. SkyKite has the right, without prior notice, to remove from publication, suspend, or cancel any account that it determines to be within the scope of prohibited items, and may be obligated to inform official authorities where necessary.

7. Account Opening, Membership, and Usage Rights

To open an account on the Platform, you must be over 18 years of age, have legal capacity, and be capable of transacting under Turkish law. The information provided during registration must be accurate, current, and complete. Account information is personal; transferring, renting out, or sharing the account with others is prohibited. You are responsible for the security of your password; if you notice unauthorized use of your password or a security breach related to your account, you must notify us immediately.

SkyKite may temporarily or permanently suspend or cancel accounts that violate these terms, engage in fraudulent transactions, create prohibited-item requests, harm other users, create suspicion of fraud, or disturb public order, without prior warning. Deletion of an account does not eliminate accrued or future rights and obligations.

8. General Obligations and Prohibited Conduct

The User undertakes not to engage in and to refrain from the following when using the Platform:

  • Providing false, misleading, incomplete, or deceptive information; using fake identities or documents;
  • Attempting fraud, trickery, blackmail, threats, or coercion;
  • Blocking the operation of the Platform, attempting unauthorized access to systems, data scraping, reverse engineering, or using automated tools;
  • Collecting, storing, sharing, or misusing other users' personal data without permission;
  • Sharing insulting, profane, obscene, racist, hate-speech, and similar content;
  • Attempting to redirect users to other channels outside the Platform and bypass the Platform's operation;
  • Making statements and engaging in conduct that harms the Platform's reputation and commercial credibility;
  • Sending spam, chain messages, chain emails, pyramid schemes, and chain letters;
  • Uploading or sharing content that infringes intellectual/industrial property rights;
  • Other conduct contrary to public order, laws, morals, decency, and general ethical rules.

Combating Fraud and Forgery

SkyKite applies a zero-tolerance policy against fraud, forgery, and abuse. Acts such as using fake accounts or documents, misleading parties with deceptive listings and offers, inducing delivery of an item without paying its price, failing to pay for an item received, impersonating another user, sharing phishing links or fake payment pages, and directing users outside the Platform to unrecorded and unprotected payments may constitute the crime of fraud under Turkish Criminal Code No. 5237 and are serious breaches of this Agreement. Accounts deemed to have committed such acts will be suspended or closed without prior notice; transaction records and relevant data may be shared with competent authorities upon legal request.

Basic rules users must observe against fraud:

  • SkyKite officials will never, under any circumstances, ask for your password, SMS/e-mail verification code, card details, or remote access applications; do not trust such requests and report them immediately.
  • Keep communication on the Platform; be cautious of requests that direct you to external messaging apps or social media and that create urgency and pressure.
  • Make payments in a way that leaves a receipt or collection record; before payment, verify that the IBAN matches exactly the information shown on the transaction page.
  • If you are unsure about the authenticity of product or payment images, do not proceed with the transaction; report suspicious users, listings, and messages to info@skykite.com.tr.

Since SkyKite is not a party to or guarantor of transactions between users, responsibility in all legal disputes, including fraud, belongs to the relevant Users; however, in acts constituting a crime, SkyKite cooperates with competent judicial and administrative authorities and makes the required notifications.

Each User is personally responsible for the legality of their communications and content shared via the Platform. In the event of a legal request or suspected violation, SkyKite reserves the right to examine, remove content, and notify relevant authorities in accordance with the privacy policy.

9. Users' Responsibilities Toward Each Other

The entire legal relationship between the Requester and the Passenger is subject to the relationship they establish between themselves. The parties must clearly agree between themselves on the offer price, delivery terms, nature of the item, timing, and payment method. The parties must act within the framework of good faith and comply with the rules of honesty.

The User is responsible for making payments for services received, fulfilling their promises, and compensating damages caused by their own actions. Disputes and damages arising between the parties in the event of damage to, loss of, non-delivery, or delay of the item are resolved exclusively between the parties themselves.

10. Limitation of the Platform's Liability and Disputes

Since SkyKite is not a party to the legal relationship being established between Users and does not assume any guarantor role, it is not liable in any way for transactions, agreements, performances, disputes, damages, indemnities, delays, and similar matters between Users. Users shall first attempt to resolve their disputes between themselves in good faith.

However, in unresolved disputes, the Platform's complaint mechanism may be used. In such cases, SkyKite may act only as an impartial third party, hearing the parties' statements and, where feasible, proposing a solution; however, this activity does not cause SkyKite to be made a party or intervenor in lawsuits filed by any of the parties, to be placed under obligation, or to be held liable. The Platform's proposals, settlement offers, and decisions do not constitute binding arbitration.

SkyKite does not guarantee uninterrupted, error-free, and secure provision of the service. It is not liable for indirect damages arising from technical failures, maintenance work, internet infrastructure outages, and similar events. The accuracy of listings, offers, and content uploaded by Users is the sole responsibility of the relevant User; SkyKite is not obliged to review such content in advance.

11. Intellectual and Industrial Property Rights

The overall appearance, design, texts, graphics, logos of the Platform, the name and trademark "SkyKite", and all content on the Platform belong to SkyKite or its licensors and are protected under the Turkish Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769. The User may not copy, reproduce, distribute, commercially exploit, or create derivative works from Platform content outside the Platform. Ownership of content uploaded by the User belongs to the User; however, the User is deemed to have granted a non-exclusive, non-transferable, revocable license for the Platform to use, store, and present such content for the purpose of providing the service.

12. Protection of Personal Data

The User's personal data is processed in accordance with the KVKK and relevant legislation, for the purposes and on the legal grounds specified in the privacy policy and KVKK disclosure text. Detailed information can be found in the Privacy Policy and the KVKK Disclosure Text published on the Platform.

Transaction records relating to membership, listings, requests, offers, messaging, payment, and delivery processes carried out via the Platform; transaction and security audit records (IP, device, session, and transaction logs) are retained for the periods prescribed by Law No. 6563, Law No. 5651, and relevant legislation. Where duly requested by competent courts, prosecutors' offices, law enforcement units, customs administration, and other competent public institutions, these records may be shared with the relevant authorities. SkyKite cooperates with competent authorities for the purposes of combating crime and protecting public order.

13. Modification or Termination of the Service

SkyKite reserves the right to expand or narrow the scope of the service, change certain functions, or temporarily/permanently discontinue the Platform in whole or in part. The User may delete their account at any time via the Platform; this does not eliminate rights and obligations accrued until the time of deletion. SkyKite may terminate a user's membership unilaterally with notice in the presence of an important reason.

14. Amendments to the Agreement

SkyKite may amend this Agreement whenever necessary. Amendments enter into force upon publication on the Platform. Users who continue to use the Platform after the date of the amendment are deemed to have accepted the changes; users who do not accept must stop using the Platform by terminating their membership. The User is obliged to regularly follow the current Agreement.

15. Force Majeure

Natural disasters, war, terrorism, strikes, epidemics, official decisions, infrastructure and internet outages, and similar circumstances beyond the parties' control that are unforeseeable and unavoidable constitute force majeure. During force majeure, the parties' obligations are suspended; neither party can be held liable for violations occurring during this period.

16. Governing Law, Jurisdiction, and Enforcement Offices

The laws of the Republic of Turkey apply to all disputes arising from this Agreement or relating to the use of the Platform. In resolving disputes, the courts and enforcement offices of the Republic of Turkey have jurisdiction. This Agreement is concluded and enters into force upon the User's commencement of use of the Platform.

18. Severability and Effectiveness

The invalidity or unenforceability of any provision of this Agreement does not affect the validity of the other provisions. The Agreement enters into force upon publication on the Platform and remains in force as long as the User continues to use the Platform. Last updated: 14.09.2026.
